A refusal from the immigration authorities may have significant consequences – whether the case concerns a residence permit, work permit, family reunification or a visa. In many cases, it is possible to have the refusal reviewed by submitting an appeal to the Immigration Appeals Board, but this requires that the appeal is properly prepared from the outset and submitted within the applicable deadline.

An appeal begins with a thorough review of the decision, including the reasoning, the factual information in the case and the authorities’ application of the rules and practice. It may be difficult to assess which factors are decisive and which additional documentation best supports the case. Advice is therefore provided on how the appeal should be structured and which arguments and supporting documents are of greatest importance.

Assistance is provided with the preparation and submission of a well-reasoned appeal, including the structuring of documentation and compliance with deadlines. Throughout the process, advice is also provided on the further course of the case, including what can be expected in terms of processing and what options are available if the appeal does not result in a change of the decision – for example, reapplication or other relevant steps depending on the case.

If the appeal deadline has expired, it may in certain cases be possible to request a reopening of the case. Assistance can be provided in assessing whether new material information exists that was not included in the original decision and which may justify a reopening. In such situations, assistance is provided with the preparation and submission of a request for reopening, as well as relevant documentation.

The aim is to ensure that the appeal is clear, legally well-founded and sufficiently documented, so that the case is considered on the best possible basis.
